Terms of Use
Effective August 20, 2026. These terms form a binding agreement between you and Armada Cyber Defense LLC, the developer of Capability Statement Studio.
1. Acceptance of terms
By accessing capabilitystatement.us or using Capability Statement Studio (the "Service"), you agree to these Terms of Use and to our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to both you and that organization. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. Accounts require a verified business email address. Sign up from public consumer email domains may be blocked unless an exception is granted by an administrator. You are responsible for the accuracy of your registration data, for safeguarding your credentials, and for all activity under your account.
3. The Service
The Service lets you import or enter business data, tailor content for specific solicitations with AI assistance, design a one page layout, preview the result, and export a PDF capability statement. Features, templates, rule libraries, and model providers may change as the Service evolves.
4. Pricing, subscriptions, and downloads
You may build and preview capability statements at no cost. A paid subscription is required to download PDF exports. Plans, prices, token allowances, and included features are shown on the subscriptions page and may be updated with notice for future billing periods.
Subscriptions are billed in advance through Stripe on a recurring basis until cancelled. You authorize us and Stripe to charge your payment method for each renewal. You may cancel at any time through the customer portal, and access continues through the end of the paid period. A short grace period may apply after cancellation or a failed payment so that in progress work can be completed while status updates propagate.
Except where required by law, payments are non refundable and partial periods are not prorated. Fees are exclusive of taxes, which you are responsible for where applicable.
5. Usage limits and fair use
Each plan includes a token allowance for AI tailoring and a limit on exports. Usage is metered and shown in your account. We may throttle, queue, or suspend requests that exceed your plan, that place disproportionate load on the Service, or that appear automated or abusive.
6. Your content and license
You retain all ownership of the business data, text, logos, and images you submit ("Your Content"). You grant Armada a limited, non exclusive, worldwide license to host, process, transmit, render, and display Your Content solely to operate and improve the Service for you, including transmission to AI model providers and PDF rendering providers as needed to fulfill your requests.
You represent that you have the rights to submit Your Content, that it does not infringe third party rights, and that all certifications, set aside statuses, contract vehicles, and past performance claims it contains are accurate and current.
7. AI generated output
AI features produce drafting suggestions. Output may be incomplete, outdated, or incorrect, and similar output may be generated for other users. You are solely responsible for reviewing, verifying, and editing all output before use. Do not submit classified, controlled unclassified, export controlled, or otherwise restricted information.
Nothing in the Service constitutes legal, contracting, accounting, or compliance advice, and we do not guarantee any contract award, registration outcome, or evaluation result.
8. Acceptable use
You agree not to misrepresent your business, certifications, or socioeconomic status; upload malware or unlawful content; probe, scrape, reverse engineer, or circumvent access controls, paywalls, or usage metering; resell or sublicense the Service without written permission; interfere with other users; or use the Service in violation of any law, export control, or sanctions regime.
9. Third party services
The Service integrates third party providers including Stripe for payments, AI model vendors, PDF rendering services, email delivery, form handling, and public data sources such as SBA DSBS, SAM.gov, and USASpending.gov. Their availability and accuracy are outside our control, and their own terms govern your use of them. Public data is provided as retrieved and should be independently verified.
10. Intellectual property
The Service, including its software, design system, rule libraries, templates, and branding, is owned by Armada Cyber Defense LLC and protected by intellectual property laws. Subject to these terms and an active plan where required, you receive a limited, revocable, non transferable license to use the Service and to use the capability statements you export for your own business purposes.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non infringement, accuracy, and uninterrupted or error free operation.
12. Limitation of liability
To the maximum extent permitted by law, Armada Cyber Defense LLC and its officers, members, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost contracts, lost data, or business interruption, arising from or related to the Service. Our total aggregate liability for any claim will not exceed the greater of one hundred United States dollars or the amounts you paid us in the twelve months before the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Armada Cyber Defense LLC from claims, damages, liabilities, and expenses, including reasonable attorney fees, arising out of Your Content, your use of the Service, or your violation of these terms or of applicable law.
14. Suspension and termination
We may suspend or terminate access if you breach these terms, if payment fails, or if we reasonably believe continued access creates legal or security risk. You may stop using the Service at any time and request deletion of your account. Sections concerning content license, disclaimers, liability, indemnification, and governing law survive termination.
15. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. The state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction over any dispute, and you consent to venue there. Each party waives any right to a jury trial and to participate in a class action.
16. Changes to these terms
We may modify these terms. Material changes will be posted in the application or sent by email, and the effective date will be updated. Continued use after the effective date constitutes acceptance of the revised terms.
